Zusammenfassung: | In November 1990 the Legal and Constitutional Committee of the ANC published a Bill of Rights for a new South Africa. Unlike the Constitutional Guidelines published by the ANC in 1988, the draft Bill of Rights is not a formal statement of ANC policy. It is a working document, issued to contribute the debate about South Africa's constitutional future and to enable the Constitutional Committee to canvass a wide range of opinion on the form and contents of a Bill of Rights before submitting a draft to the National Executive. This note looks at three controversial matters covered in the Bill: property rights; social, economic and welfare rights; and women's rights. Despite some criticism, the author concludes that the Bill of Rights contributes significantly to attempts to establish a more just order in South Africa.
