Zusammenfassung: | German-language laws are compared in terms of genesis and content, as well as with the practice of archaeological heritage management. In the relatively new German laws (especially the laws of East Germany), there is a stronger emphasis on both the responsibility and the participation of individuals than in the older laws of Austria and Switzerland, where instead the state assumes responsibility. This must be an effect of international conventions and approaches to modern administrative ethics. Ethical content is provided by regulations on the public interest, which places the interests of the common good above individual interests, on a public interest in remembrance, on the participation of individuals from property obligations, from responsibility as initiators, and from a claim to participation and involvement. These aspects are illustrated using practical everyday examples from Brandenburg. The handling of human remains from contexts of war and terror is also discussed here, providing state archaeology with a new mission and new opportunities: participation in political education. |
