Zusammenfassung: | "This volume advances a framework for analyzing and thinking about transnational law and transnational legal regimes. It approaches transnational 'law' as consisting of that collection of transnational institutions and practices with which persons with legal training are increasingly being asked to or invited to engage. Its purpose, correspondingly, is to facilitate such engagement: to help the legal actor better understand what to look for, and what the practical and normative implications of what she finds are, when she encounters such institutions and practices. It does this by identifying the various 'facets' of transnational institutions and practices that are most interest to persons working from the perspective of law (e.g., bases of legitimacy, regulatory activities, governance structures); exploring how different regulatory regimes structure these facets in different ways in order to serve different regulatory purposes; and investigating how a regulatory regime's choice as to how to structure any one of these facets affects what the other facets of that regime can and cannot do effectively and, beyond that, the reach and shape of the regime's overall legitimacy"-- |
